Information about the processing of your personal data by Fansy.
Fansy is committed to protecting your privacy and ensuring the highest level of security for your personal data.
Fansy provides users and customers (hereinafter referred to as “Users”) with a mobile application & web platform (“the Platform”) that grants access to different types of subscriptions for using the Fansy Platform. Visiting the Platform is generally possible without providing personal data. Access to certain services, notably subscription sign-up, requires the processing of Users’ personal data by Fansy.
This Privacy Policy aims to explain how Fansy uses your personal data when you navigate the Platform and access the services offered.
This Privacy Policy applies only to Users of the Platform and to the services provided by Fansy.
As the controller responsible for processing Users’ personal data, Fansy complies with Regulation (EU) 2016/679 of April 27, 2016 (“GDPR”) and the amended French Law on Information Technology, Data Files and Civil Liberties of June 6, 1978.
If you refuse to provide certain mandatory information necessary to access the offered services, Fansy will be unable to provide those services.

Fansy also specifies that it is not responsible for the processing of personal data by third parties that the User may utilize through the Fansy Platform and that are  hosted by Fansy. Fansy acts as a data processor as defined by Article 4.8 of the GDPR for personal data collected by the User through Fansy. The processor relationship between Fansy and the User regarding data collected via Fansy is governed by a separate agreement.

2. Data collected by Fansy

Fansy collects different categories of data depending on the service or purpose:

  • Creating a user account: all information provided by the User in the contact form
    (Legal grounds: User’s consent, and the execution of a contract between Fansy and the User)
  • Taking out a paid subscription and issuing invoices: information required for billing, including payment details
    (Legal grounds: User’s consent, and the execution of a contract between Fansy and the User)
  • Responding to customer service requests (by chat, email, through the Site): contact details provided by the User
    (Legal grounds: User’s consent, and Fansy’s legitimate interest in managing customer relationships)
  • Technical support for the Site and usage statistics: User’s contact details, technical information about the device or operating system, date and time of connection
    (Legal grounds: Fansy’s legitimate interest, and the execution of a contract)
  • Platform and service security: technical information about the device or operating system, date and time of connection
    (Legal grounds: Fansy’s legitimate interest)
  • Establishing Site usage statistics: anonymized usage data
    (Legal grounds: User’s consent)
  • Fraud prevention for subscription payments: payment and billing data
    (Legal grounds: execution of the contract between Fansy and the User, and Fansy’s legitimate interest)

3. Source of data processed by Fansy

Fansy collects data directly from Users when using the Platform or services and subscriptions offered therein. Technical data is generated automatically while using the Site or services.

4. How long are my data retained?

User data is kept for three (3) years from the last inbound contact or positive action on the Site, within the User’s account, or through usage of the offered services.
Fraud prevention records are retained for 3 years.
Invoices for services and subscriptions are kept for 10 years.

5. Are my data shared with third parties?

Within Fansy, data access is strictly limited to authorized personnel only.
Fansy may also disclose data to third parties, only where justified and after verifying legal compliance, notably:

  • Technical service providers (data hosting, etc.)

  • Financial service providers (accountants, payment services)

  • Administrative authorities and law enforcement when required by law

  • Judicial or administrative authorities upon request and where there is a legal obligation

6. Are my data transferred outside the EU?

Some data may be processed outside the European Union, especially to the United States, for the purposes of using social networks, web analytics, certain IT and maintenance services. Prior to any transfer outside the EU, Fansy implements all necessary procedures to secure such transfers. For transfers to the United States involving Google and social network services, standard contractual clauses are in place.

7. What does Fansy do to guarantee data security?

Protecting your personal data is of utmost importance to Fansy. Fansy implements adequate and sufficient security and confidentiality measures in accordance with the GDPR to process and store its Users’ data. Common security measures include physical security of facilities, IT system security to prevent external access, and secure backup procedures. When using subcontractors, Fansy ensures their compliance with data protection rules. If Fansy detects a personal data breach that could pose a high risk to your rights and freedoms, you will be informed as quickly as possible.

8. Data of minors under 15

In France, the age of digital majority is set at 15. Fansy’s services are intended for people 15 years of age and older. Minors below the age of digital majority in their country must use Fansy only under the supervision and with the consent of their legal representatives.

9. Your rights

Any person whose data is processed by Fansy can exercise the following rights:

  • Access to their data

  • Correction of inaccurate or incomplete data

  • Deletion of personal data

  • Opposition to processing

  • Opposition to profiling

  • Limitation of processing

  • Data portability

  • Withdrawal of consent

Your request may be subject to identity verification. Fansy will respond to your request within one month. In some cases, depending on the complexity or number of requests, this period may be extended by up to two months.
